Terms of Service

Terms and conditions for using the Scouted app.

1. Introduction

Welcome to Scouted. These Terms of Service ("Terms") govern your access to and use of the Scouted mobile application ("App," "Service," or "Scouted"). By creating an account, downloading the App, or otherwise using Scouted, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

Scouted is a mobile application designed to help high school athletes organize and manage their college recruiting process. It is important to understand that Scouted is an organizational tool — it is not a recruiting service. We do not recruit athletes, contact coaches on your behalf, guarantee placement at any institution, or promise any particular recruiting outcome.

2. Service Description

Scouted provides a suite of tools designed to help high school student-athletes stay organized throughout their college recruiting journey. The App enables you to:

  • Track schools you are interested in and organize them by status and priority
  • Log conversations with college coaches and keep detailed notes
  • Manage camp registrations, campus visits, and other recruiting events
  • Store coach contact information and communication history
  • Set follow-up reminders so you never miss an important deadline or touchpoint
  • Receive personalized insights, including conversation summaries and suggested questions to ask coaches

Scouted helps you organize information that you provide — it does not independently recruit athletes, guarantee scholarships or athletic financial aid, contact coaches or institutions on your behalf, or make any representations about your likelihood of being recruited by any school. All recruiting decisions and actions remain solely your responsibility.

3. Account Registration

To use Scouted, you must create an account. When registering, you agree to provide accurate, current, and complete information, including your name, email address, sport, and graduation year. You are responsible for keeping your account information up to date.

You must be at least 13 years of age to create an account and use Scouted. We do not knowingly collect information from children under 13, and any such accounts will be terminated upon discovery.

If you are under 18, we encourage you to review these Terms and our Privacy Policy with a parent or guardian before using the App. Before creating an account, every new user is presented with a consent screen requiring them to either (1) confirm they are 18 years of age or older, or (2) confirm they are at least 13 years old and that a parent or legal guardian has reviewed these Terms and our Privacy Policy. Both documents must be opened and reviewed before the agreement button becomes available. This consent is based on self-attestation — we rely on the user's honest representation and do not independently verify the user's age or confirm that a parent or guardian has actually reviewed these documents. By allowing a minor to use Scouted, the parent or legal guardian acknowledges and agrees to be bound by these Terms on the minor's behalf and accepts responsibility for the minor's use of the App. Parents and guardians may terminate their child's account at any time by contacting us at [email protected] or by using the account deletion feature within the App. Upon termination, the minor's data will be deleted in accordance with our data retention policy. Parents and guardians may also contact us at any time to review their child's data or withdraw consent by emailing [email protected]. We will verify the parent or guardian's identity and relationship to the minor before processing any such request.

You acknowledge that contracts with minors may be voidable under applicable law. If a minor user disaffirms this agreement, the parent or legal guardian's consent, indemnification obligations, and acceptance of responsibility under these Terms remain in full force and effect to the extent permitted by law.

Each person may maintain only one Scouted account. You are responsible for maintaining the confidentiality of your account credentials, including your password and any authentication tokens. You agree to notify us immediately at [email protected] if you become aware of any unauthorized access to or use of your account. You are responsible for all activity that occurs under your account.

4. Subscription Terms

Scouted offers two subscription tiers:

  • Standard — Provides access to all core features with a limit of 4 schools you can track. Family sharing is not included.
  • Pro — Provides unlimited school tracking and all features, including family sharing.

Pro subscriptions are billed through the Apple App Store or Google Play Store. By subscribing to Scouted Pro, you agree to the following billing terms:

Apple App Store

  • Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period.
  • Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current billing period.
  • You can manage and cancel your subscription at any time through your Apple App Store account settings.
  • Refunds are handled in accordance with Apple App Store policies. If you believe you are entitled to a refund, please contact Apple Support or submit a request through the App Store.

Google Play Store

  • Your subscription will automatically renew at the end of each billing period unless you cancel before the end of the current period.
  • Your Google account will be charged for renewal at the start of each new billing period.
  • You can manage and cancel your subscription at any time through the Google Play Store app or play.google.com.
  • Refunds are handled in accordance with Google Play Store policies. If you believe you are entitled to a refund, please contact Google Play Support or submit a request through the Play Store.

Subscription prices are subject to change. We will provide notice of any price changes, and your continued use of the Pro subscription after such changes constitutes acceptance of the new pricing. Scouted does not independently process refunds for app store purchases.

Minor Users

If you are under 18, you must have your parent or legal guardian's consent before purchasing a Scouted Pro subscription. All subscription purchases are processed through the Apple App Store or Google Play Store, which provide their own parental controls and purchase authorization settings. The parent or legal guardian who consented to these Terms accepts responsibility for any subscription charges incurred by the minor user.

5. Family Sharing

Scouted Pro subscribers may use the optional family sharing feature to invite up to two designated family members to view their recruiting profile in read-only form. Family sharing is a voluntary feature controlled entirely by the athlete.

Eligibility

Family sharing is available to Pro subscribers only. The invited family member must create a separate Scouted account and must attest that they are 18 years of age or older before accepting the invitation. Family accounts are free and do not require a subscription. A family account may be linked to multiple athletes simultaneously. The family member views one athlete's profile at a time and can switch between linked profiles within the app. The athlete is responsible for ensuring they share only with appropriate individuals — Scouted does not independently verify the identity or age of family members.

What Family Members Can and Cannot Do

Family members have read-only access to the athlete's full recruiting profile, including school lists, coach and advisor contacts, conversation logs (including synced emails and imported text messages), AI-generated summaries and suggestions, and recruiting calendar events. Family members cannot modify any data, trigger AI processing, or export the athlete's data.

Revocation

The athlete may revoke a family member's access at any time through the app's settings. Revocation takes effect immediately. Upon revocation, the family member will no longer be able to view any of the athlete's data. The family member's account is not deleted and they may accept a new invitation in the future if invited again.

Subscription Dependency

Family sharing requires an active Pro subscription on the athlete's account. If the athlete's Pro subscription lapses, the family member's access is suspended until the subscription is renewed. We are not obligated to provide advance notice of access suspension resulting from a lapsed subscription.

Athlete Responsibility

By creating a family sharing invitation, the athlete acknowledges that they are sharing their full recruiting profile — including all communications, notes, and AI-generated content — with the invited person. The athlete assumes responsibility for any consequences arising from their choice of whom to invite. Scouted is not liable for any misuse of shared data by a person the athlete has invited.

Minor Athletes

Minor users (ages 13–17) may use family sharing. Parents and guardians of minor athletes are encouraged to discuss family sharing with their child. If a parent or guardian believes a minor has shared their profile with an inappropriate person, they may contact us at [email protected] to request revocation of any active link. We will verify the requestor's relationship to the minor before acting.

6. Acceptable Use

You agree to use Scouted only for its intended purpose — organizing your college recruiting process — and in compliance with all applicable laws and regulations. You agree not to:

  • Use the App to harass, threaten, defame, or intimidate any person, including coaches, athletes, or other users
  • Use the App for any illegal activity or in violation of any applicable local, state, national, or international law
  • Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the App
  • Use automated scripts, bots, scrapers, or other automated means to access the App or extract data from it
  • Interfere with or disrupt the integrity or performance of the App or its underlying infrastructure
  • Upload or transmit any viruses, malware, or other harmful code through the App
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity

All content and information you enter into Scouted should be accurate to the best of your knowledge. You must not share your account credentials with any other person. Violation of these acceptable use guidelines may result in suspension or termination of your account.

7. Intellectual Property

The Scouted App, including its design, source code, user interface, graphics, features, functionality, and all related documentation, is the exclusive property of Scouted and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted in these Terms are reserved.

You retain full ownership of all data and content that you enter into the App, including your school lists, coach contact information, conversation logs, notes, and any other recruiting-related information you create or upload. We claim no ownership over your user-generated content.

By using the App, you grant Scouted a limited, non-exclusive, non-transferable license to use, process, and display your content solely for the purpose of providing, maintaining, and improving the Service. This license exists only for as long as your account is active and is used exclusively to deliver the functionality of the App to you.

The Scouted name, logo, and all related brand elements are trademarks of Scouted. You may not use these trademarks without our prior written consent.

8. User Content

You retain full ownership of all recruiting data and content you enter into Scouted. This includes, but is not limited to, your school lists, conversation logs, coach information, camp details, notes, questions, and any other information you create within the App. Your data is yours.

Scouted Pro subscribers have the ability to export their recruiting data from the App, giving you a portable copy of your information that you can use outside of Scouted. We believe you should always have access to the data you create.

We do not sell your personal data or recruiting information to third parties. We may use anonymized, aggregated data — data that has been stripped of all personally identifiable information and combined across users — to analyze usage patterns, improve the App's features, and enhance the overall experience for all users. This aggregated data cannot be used to identify any individual user.

9. Smart Features Disclaimer

Scouted offers smart personalized features, including conversation summaries, suggested questions to ask coaches, and other tailored insights. These features use third-party AI services to analyze your recruiting data (such as conversation logs, school details, and imported message screenshots) and generate personalized results.

You acknowledge and agree that:

  • Generated content is provided for informational purposes only and should not be treated as professional recruiting advice, legal guidance, or a substitute for your own judgment and research.
  • We do not guarantee the accuracy, completeness, or reliability of any generated output. Automated systems can produce errors, and you should always verify important information independently.
  • Smart features process your recruiting data (conversation logs, school information, notes) to generate insights, but we never send your personal contact information (such as your email address or full name) to third-party services.
  • All AI data protections apply equally to minor users. No personally identifying information about minor users is retained by our AI service providers, and all AI processing occurs under zero data retention agreements.
  • Personalized suggestions are meant to supplement — not replace — your own decision-making in the recruiting process.

10. NCAA and Athletic Organization Disclaimer

Scouted is not affiliated with, endorsed by, sponsored by, or in any way officially connected to the National Collegiate Athletic Association (NCAA), the National Association of Intercollegiate Athletics (NAIA), the National Junior College Athletic Association (NJCAA), or any other collegiate athletic organization, conference, or institution.

Scouted is strictly an organizational tool designed to help you keep track of your own recruiting process. The App does not provide guidance on NCAA eligibility, compliance rules, recruiting regulations, or any rules governing athletic recruitment at any level.

You are solely responsible for understanding and complying with all applicable recruiting rules, regulations, and guidelines established by the NCAA, NAIA, NJCAA, your state athletic association, and any schools or conferences you are engaging with. This includes ensuring that your use of Scouted — including the storage, review, and management of communications with coaches and athletic programs — complies with all applicable rules governing recruiting contacts, communications, and permissible activities. If you have questions about recruiting rules or compliance, we strongly encourage you to consult directly with the relevant athletic organization or a qualified compliance professional.

11. Limitation of Liability

The Scouted App and all of its features are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by applicable law, Scouted and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use of or inability to use the App
  • Missed recruiting deadlines, lost opportunities, or decisions made based on data or information within the App
  • Any unauthorized access to or alteration of your data or transmissions
  • Any loss of data, even though we take reasonable precautions to protect your information
  • Any errors, inaccuracies, or omissions in automatically generated content
  • Any interruptions, bugs, or errors in the App's functionality

In no event shall Scouted's total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the App exceed the total amount you have paid to Scouted in the twelve (12) months immediately preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Scouted and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or access to the App; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; or (d) any content or data you provide through the App. If you are a minor, your parent or legal guardian who consented to these Terms agrees to this indemnification on your behalf.

13. Termination

We reserve the right to suspend or terminate your account at any time if we determine, in our sole discretion, that you have violated these Terms of Service, engaged in fraudulent or abusive behavior, or used the App in a manner that could harm Scouted, other users, or third parties. We will make reasonable efforts to notify you of any suspension or termination, but we are not required to do so in advance.

You may delete your account at any time using the account deletion feature within the App or by contacting us at [email protected]. Upon account deletion, your personal information and recruiting data will be removed from our active systems. Please note that some data may be retained in encrypted backups for a reasonable period as part of our standard infrastructure practices, after which it will be permanently deleted.

Termination of your account does not relieve you of any obligations or liabilities incurred prior to termination. Sections of these Terms that by their nature should survive termination (including, without limitation, intellectual property provisions, disclaimers, indemnification, limitations of liability, and dispute resolution) shall continue to apply.

14. Changes to Terms

We may modify, update, or revise these Terms of Service from time to time to reflect changes in our practices, new features, legal requirements, or other factors. When we make material changes, we will notify you through the App so you are aware of the updated terms before they take effect.

Your continued use of Scouted after any modifications to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should discontinue your use of the App and delete your account. We encourage you to review these Terms periodically to stay informed about your rights and obligations.

15. Governing Law & Dispute Resolution

These Terms of Service and any disputes arising out of or relating to them shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the use of Scouted shall, to the extent permitted by law, be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree that any arbitration shall be conducted on an individual basis and not as a class action or representative proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration against Scouted. Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits. The arbitration and dispute resolution provisions of this section survive account deletion and termination of these Terms.

Minor users: For users under 18 years of age, these arbitration and class action waiver provisions are agreed to by the parent or legal guardian who consented to these Terms on the minor's behalf. The parent or guardian's agreement to binding arbitration and class action waiver is made on behalf of the minor and is independent of and survives the minor's right to void these Terms. Any arbitration involving a minor user requires the participation of the minor's parent or legal guardian. To the extent applicable law prohibits enforcement of arbitration agreements or class action waivers against minor users, such provisions shall not apply.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

16. State-Specific Rights

Depending on your state of residence, you may have additional rights regarding your personal information and use of the App. For a detailed description of your state-specific privacy rights, please see our Privacy Policy.

We do not sell personal data, engage in targeted advertising, or profile users for any purpose other than providing and improving the Scouted service. To exercise any state-specific privacy rights, please contact us at [email protected].

17. General Provisions

Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Scouted regarding your use of the App and supersede all prior agreements, understandings, and communications, whether written or oral, relating to the subject matter herein.

Force Majeure

Scouted shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, internet or telecommunications failures, power outages, pandemics, or other force majeure events.

No Waiver

No failure or delay by Scouted in exercising any right, power, or privilege under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise preclude any other or further exercise of any right, power, or privilege.

Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. Scouted may assign these Terms without restriction. Subject to the foregoing, these Terms shall bind and inure to the benefit of the parties and their respective successors and assigns.
